Limited Liability Company "MonPet" (OGRN 1197746758901, TIN 9710080825), hereinafter referred to as the "Seller", offers the user of the website https://monpet.com (hereinafter referred to as the "Website"), hereinafter referred to as the "Buyer", to purchase digital cards (MonCards) under the terms set forth in this User Agreement.

1. General Provisions

• 1.1. This agreement is a public offer in accordance with Article 437 of the Civil Code of the Russian Federation.
• 1.2. Acceptance of the offer — the Buyer's payment for digital cards (MonCards) — means full and unconditional acceptance of all terms of this agreement.
• 1.3. The Seller has the right to change the terms of this offer unilaterally without prior notice. The current version of the agreement is posted on the Website.
• 1.4. Digital cards (MonCards) are not a means of payment, an investment asset, or a product with the characteristics of a financial instrument.

2. Subject of the Agreement

• 2.1. The Seller provides the Buyer with the opportunity to purchase digital cards (MonCards) posted on the Website. Information about characteristics, cost, and purchase conditions is posted in the product card.
• 2.2. The Buyer confirms that before making payment, they have familiarized themselves with the description of the digital card (MonCard) being purchased and agree with its characteristics and terms of use.

3. Payment, Delivery, and Card Display Terms

• 3.1. Payment is made on the Website using available methods: bank card, payment systems, etc.
• 3.2. After payment, the Buyer is provided with access to the digital card (MonCard) in their personal account or by email. The card may contain the name and amount specified when placing the order. Any changes to the card (including name or amount) after receiving it are prohibited.
• 3.3. The date of conclusion of the contract is the date of crediting funds to the Seller's account.
• 3.4. The Buyer may also make a direct transfer of funds from their bank account using the details specified in Section 9 of this Agreement.
• 3.5. Online payment security guarantees:
  • - Payment processors (Stripe, YooKassa) protect and process the Buyer's bank card data according to the PCI DSS security standard.
  • - Information is transmitted to the payment gateway using SSL encryption technology.
  • - Further transmission of information occurs through closed banking networks.
  • - Payment processors do not transmit the Buyer's bank card data to the Seller and/or other third parties.
  • - The 3D Secure protocol is used for additional authentication.
  • - Bank card data is transmitted only in encrypted form and is not stored on the Seller's servers.
  • - Card processing is carried out in accordance with the requirements of VISA, MasterCard, MIR, and other payment systems.
• 3.6. In case of questions regarding the completed payment, the Buyer can contact the support service of the corresponding payment service (Stripe or YooKassa).

4. Terms of Use of Digital Cards (MonCards)

• 4.1. The Buyer has the right to purchase digital cards (MonCards) with a fixed denomination or choose an individual amount for which a special card will be issued. Information about the denomination and type of card is displayed on the Website when making a purchase.
• 4.2. All digital cards (MonCards) and their visual design (including images, design, compositions, captions, and other elements) are objects of copyright and are protected in accordance with the legislation of the Russian Federation and international treaties.
• 4.3. Copying, modification, distribution, reproduction of digital cards (MonCards), as well as their use for commercial purposes without prior written permission from the Seller, is prohibited.
• 4.4. The Buyer is allowed to post the purchased digital card (MonCard) in its unchanged form on social networks, messengers, blogs, and other public resources solely for the purpose of promoting the MonPet project and demonstrating participation in it.

5. Personal Data Processing

• 5.1. By entering into this agreement, the Buyer provides consent to the processing of their personal data, including collection, recording, systematization, storage, clarification, extraction, use, transfer, anonymization, and destruction, solely for the purpose of fulfilling this agreement.
• 5.2. The Seller undertakes not to disclose the Buyer's personal data to third parties without their consent, except in cases established by law or upon an official request from government authorities.

6. Other Terms

• 6.1. The Buyer has the right to refuse recurring (repeated) payments at any time, if provided, by sending a corresponding notification to hello@monpet.com.
• 6.2. This agreement is an adhesion contract in accordance with Article 428 of the Civil Code of the Russian Federation. The terms of this Agreement are determined by the Seller and accepted by the Buyer by unconditionally joining them in full, without any exceptions, reservations, or additional conditions. The Buyer confirms that this Agreement does not contain burdensome or obviously unfair conditions that they would not have accepted if they had the opportunity to participate in the discussion of the Agreement's terms. By making a purchase, the Buyer understands the legal significance of their actions and expresses informed consent to the stated terms.
• 6.3. The invalidity of one of the provisions of the agreement does not entail the invalidity of the others.
• 6.4. By making a purchase, the Buyer confirms that they are familiar with the terms of this agreement, understand the meaning of their actions, and express consent to the transaction.
• 6.5. This agreement is governed by the legislation of the Russian Federation.

7. Limitation of Liability

• 7.1. The Buyer is responsible for the correctness of the data entered when placing an order (including name and amount).
• 7.2. The Seller is not liable for the inability to use the digital card (MonCard) if it is caused by actions or errors on the part of the Buyer.
• 7.3. In case the Buyer provides incorrect or incomplete data, the Seller is not obliged to change the already issued digital card (MonCard).

8. Return and Exchange

• 8.1. In accordance with paragraph 4 of part 4 of Article 26.1 of the Law of the Russian Federation "On Consumer Rights Protection", digital goods provided remotely are not subject to return and exchange, except in cases of their technical malfunction.
• 8.2. Digital cards (MonCards) created based on data entered by the Buyer are not subject to return or replacement, even in case of errors made by the Buyer themselves.
