These Terms and Conditions (the "Terms") are an agreement between MONPET LLC, THE BINARY BY OMNIYAT, Dubai, UAE, License Number 1482159 (the "Seller", "we"), and the user of the website https://monpet.com (the "Website") who purchases digital cards (MonCards) (the "Buyer", "you").

1. General Provisions

• 1.1. By paying for a digital card (MonCard) you confirm that you have read, understood, and accepted these Terms in full.
• 1.2. We may update these Terms from time to time. The current version is always available on the Website; the version in force at the time of your purchase applies to that purchase.
• 1.3. Digital cards (MonCards) are digital collectibles that show support for the MonPet project. They are not a means of payment, an investment, a security, or any other financial instrument, and they carry no right to a return on money paid.

2. Subject of the Agreement

• 2.1. The Seller provides the Buyer with the opportunity to purchase digital cards (MonCards) shown on the Website. The description, price, and purchase conditions are shown on the product page.
• 2.2. Before paying, the Buyer reviews the description of the chosen digital card (MonCard) and agrees with its characteristics and terms of use.

3. Payment and Delivery

• 3.1. Prices are shown in US dollars. Payment is made by bank card or other methods offered at checkout and is processed by Stripe.
• 3.2. After payment, the digital card (MonCard) is delivered by email and becomes available in the Buyer's personal account. The card may show the name provided by the Buyer when placing the order. The card cannot be changed after it has been issued.
• 3.3. The contract is concluded when the payment is confirmed by the payment processor.
• 3.4. Card data is entered on the payment processor's secure page, transmitted over encrypted connections, and processed in accordance with the PCI DSS standard. The Seller does not receive or store your full card details. Additional authentication such as 3D Secure may be requested by your bank.

4. Use of Digital Cards (MonCards)

• 4.1. All digital cards (MonCards) and their visual design (images, compositions, captions, and other elements) are protected by copyright and other intellectual property rights belonging to the Seller or its licensors.
• 4.2. You may share your digital card (MonCard) in its unchanged form on social networks, messengers, blogs, and other public resources to show your support for the MonPet project.
• 4.3. Copying, modifying, reselling, or otherwise using digital cards (MonCards) for commercial purposes without the Seller's prior written permission is prohibited.

5. Personal Data

• 5.1. We process the personal data you provide (such as your email address and the name shown on the card) to fulfil your order, as described in our Privacy Policy.

6. Refunds

• 6.1. A digital card (MonCard) is digital content that is created and delivered immediately after payment. By completing the purchase you request immediate delivery and acknowledge that, to the extent permitted by applicable law, you lose any right to withdraw from the purchase once the card has been delivered.
• 6.2. If a card is not delivered or is technically defective, contact hello@monpet.com and we will re-issue it or refund the payment.
• 6.3. Nothing in these Terms limits the mandatory consumer rights you have under the laws of your country of residence.

7. Limitation of Liability

• 7.1. The Buyer is responsible for the accuracy of the data entered when placing an order, including the email address and name.
• 7.2. The Seller is not obliged to change an issued digital card (MonCard) if the Buyer provided incorrect or incomplete data.
• 7.3. To the extent permitted by law, the Seller's total liability in connection with a purchase is limited to the amount paid for it.

8. Governing Law and Disputes

• 8.1. These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai.
• 8.2. We will try to resolve any dispute amicably first; please write to hello@monpet.com. Disputes that cannot be resolved amicably are subject to the jurisdiction of the courts of Dubai, without prejudice to any mandatory rights you have to bring a claim in your country of residence.
• 8.3. If any provision of these Terms is found invalid, the remaining provisions stay in force.
